Introduction
"Agricultural drone" covers jobs that have almost nothing in common legally. Vigour mapping with a 1 kg drone falls in the open category and takes minutes to prepare. Releasing trichogramma wasps or broadcasting cover-crop seed, because the drone drops something, already falls outside the open category. Spraying plant protection products combines two independent regimes in France: the rural code, which prohibits aerial spraying in principle and only opens it through authorised programmes, and aviation law, which requires an operational authorisation for these heavy drones.
This edition is for professionals in farming, viticulture, livestock and forestry, and for the contractors who work for them, including readers from other countries who know EASA rules but not the French layer on top. This guide is up to date as of 30 September 2026. The French framework for drone spraying changed a great deal between April 2025 and May 2026 and will keep changing. Always check the consolidated texts on Légifrance and your regional agriculture directorate (DRAAF) before a campaign.
Which rules apply to my farm mission? The decision table
The first question is not "which drone?" but "what does the drone do?". Three families of missions, three regulatory logics.
Family 1: observe (mapping, counting, assessment)
Vigour mapping, water stress, missing-vine counts, disease detection, forest inventory, assessment of wildlife or hail damage. The drone drops nothing and usually weighs under 4 kg: this is the open category, most often A3 in open countryside (no uninvolved people in the flight area, at least 150 m from any residential, commercial, industrial or recreational area), sometimes A2 with a class C2 drone. No authorisation and no notification outside built-up areas. The real traps lie elsewhere: military low-level routes (RTBA), aerodrome surroundings, protected areas, farm buildings and hamlets that rule out A3.
Family 2: drop without plant protection products (seeding, trichogramma, granules)
Cover crops broadcast into standing maize, trichogramma releases against corn borer, targeted spreading of fertiliser granules or biocontrol slug pellets. Under the rural code, these uses are not caught by the ban on aerial spraying of plant protection products (subject to the exact nature of the product: slug pellets are still a plant protection product). Under aviation law, however, Regulation (EU) 2019/947 excludes from the open category any flight where the drone drops material: these missions fall in the specific category, even with a small drone. This is the most common confusion in the sector: "legal" from a pesticide standpoint does not mean "no authorisation" from an aviation standpoint.
Family 3: spray plant protection products
Prohibited in principle (article L. 253-8 of the French rural and maritime fishing code). Opened since 2025-2026 in strictly listed cases, through a programme authorised by the regional préfet (the state's regional representative), with products specifically approved for drone application, and in addition to an aviation operational authorisation. There is also a temporary emergency derogation mechanism, decided by ministerial order.
