Drones and Nuclear Power Plants: No-Fly Zone, Regulation and Authorised Uses

No drone mission can be improvised near a nuclear power plant: overflight is banned by default, regardless of the aircraft's weight or flight category. This framework, inherited from a wave of unexplained overflights that was never resolved, rests on a precise perimeter, criminal penalties, and an exemption process reserved to a handful of cleared operators. For any professional — agricultural, industrial, real-estate — whose mission sits near a nuclear facility, one check comes before any quote request: understanding what the regulation allows, bans and punishes.

A no-fly zone by default, born from a wave of unresolved incursions

In late 2014, a series of unidentified night-time overflights hit several French nuclear power plants within a few months. None of the aircraft was intercepted, no one claimed responsibility, and the investigation opened at the time never identified the operators. That episode, documented in a 2017 study by Solodov, Williams and Al Hanaei published in Security Journal analysing the threat unmanned aerial vehicles pose to nuclear facilities, acted as a trigger: it pushed French lawmakers to close the legal grey area that had until then surrounded the overflight of sensitive sites by an aircraft with no one on board (see the study on Google Scholar).

Law n° 2016-1428 of 24 October 2016 on strengthening the safety of civil drone use filled that gap: it created a specific offence for a remote pilot who flies an unmanned aircraft over a prohibited zone, distinct from the open- or specific-category rules that otherwise govern most professional missions. Since then, every French nuclear power plant has been a permanent no-fly zone under Article L6211-4 of the Transport Code, regardless of the drone's weight, its flight category, or the remote pilot's stated intentions.

The exact perimeter: a 5 km radius, a 1,000 m ceiling

The zoning rests on Article L6211-4 of the Transport Code, which allows the overflight of certain areas of the territory to be prohibited for military or public-security reasons, set out in an order from the minister in charge of civil aviation. Around each power plant — and more broadly every basic nuclear installation, including CEA and Orano sites — the no-fly zone extends over a 5-kilometre radius, with a flight ceiling set at 1,000 metres above ground: the entire altitude band a professional drone operates in, open category or specific, falls within it.

That zoning is anything but theoretical for a professional remote pilot: it shows up directly on the Géoportail restricted-zone map, to be checked before any mission regardless of the client — agricultural, real-estate, events or industrial. A vineyard, a construction site or a logistics facility sitting within 5 km of a power plant — the Rhône valley, the Loire and the Rhine corridor concentrate several such installations — remains a zone where any drone shoot, even one unrelated to the plant itself, calls for a systematic check before take-off.

Penalties and exemptions: a framework apart, not an open-market service

The Transport Code distinguishes two levels of severity. Under Article L6232-12, causing an unmanned aircraft to overfly a prohibited zone through negligence or carelessness exposes the remote pilot to 6 months' imprisonment and a €15,000 fine; deliberately entering or remaining in that zone raises the penalty to 1 year's imprisonment and a €45,000 fine. Liability is not limited to the remote pilot: the operator who commissioned the mission is also exposed, a point worth weighing when choosing a provider for any mission whose flight path approaches a no-fly zone.

Exemptions do exist, but they are not part of the open drone-services market: inspecting the inside of a reactor building, checking a cooling tower — a structure we cover in our guide on drone cooling-tower inspection — or carrying out radiological monitoring on a site remain reserved to a small number of cleared operators, generally under direct contract with the operator (EDF, Orano, CEA) and subject to a clearance process distinct from standard AlphaTango registration. Those authorised professional uses are nonetheless growing: a 2024 review by Ardiny, Beigzadeh and Mahani published in Nuclear Engineering and Design catalogues drone applications for radiological monitoring in nuclear settings — contamination mapping, inspecting areas hard for a human operator to reach, monitoring structures in service — all missions that, in France, go through this specific clearance route rather than a standard quote (see the study on Google Scholar).

What this means for a professional mission nearby

For the vast majority of drone missions — agricultural photogrammetry, construction-site monitoring, industrial thermography, event coverage —, the question is not obtaining an exemption to fly over the plant itself, but checking that the mission site does not overlap its 5 km perimeter. A farmer, a developer or a local authority with a plot or a site that close needs to build that check into every quote request: the Géoportail lookup takes a few minutes and avoids a rejected mission or, worse, an offence committed in good faith. The chosen provider should be able to show up-to-date professional liability insurance and a valid AlphaTango registration — two prerequisites that in no way remove the need to check the zone.

In the rarer cases where the flight path skirts the 5 km limit without ever entering it, a generous safety margin beats cutting it close: a smartphone's GPS coordinates carry a margin of error, and a no-fly zone leaves no room for approximation. Request a quote stating the site's exact location; a serious provider will systematically check the restricted-zone map before confirming the mission.

Does this ban apply to hobbyist drones too? Yes, and arguably more so: the regulation makes no distinction by weight or use for no-fly zones; a drone weighing a few hundred grams flown for leisure faces the same penalties as a professional one.

Can the plant itself legally neutralise a drone? Yes: nuclear sites operate detection and neutralisation systems authorised under domestic-security regulation, independently of any criminal proceedings brought against the drone's operator.

Does this 5 km perimeter apply to other sensitive sites too? Prohibited or restricted zones also exist around military sites or airport areas, each with its own radius and rules; only Géoportail gives the exact zoning that applies to a given site.

What if an authorised mission still needs to approach a plant (a power line, a pipeline, a neighbouring construction site)? Coordination then runs through the site operator and the relevant prefectural authorities, with several weeks to plan for; it is not a service the open drone market can offer on a standard quote.
