Drones and Prisons: No-Fly Ban, Penalties and Regulation of a Correctional Facility

A prison cannot be flown over by drone — not for professional work, not for leisure, and with none of the exemptions that exist for other sensitive sites. That principle, inherited from the same legal framework that protects nuclear power plants and military sites, has taken on particular urgency in 2026: drone deliveries of phones, drugs and sometimes weapons over prison walls are now counted in the thousands each year, far outpacing the espionage or sabotage scenarios that originally justified protecting other sensitive sites. Here is what the law says, the two offences that can stack on top of each other, and what it changes for a professional whose mission sits near a correctional facility.

A sensitive site protected like a power plant, targeted for a very different reason

Like nuclear power plants and military sites, every French correctional facility is a permanent no-fly zone, on the same legal basis: Article L6211-4 of the Transport Code, which allows certain areas of the territory to be closed off for public-security reasons, set out in an order from the minister in charge of civil aviation. This P zone shows up on the Géoportail restricted-zone map: unlike the fixed 5 km radius around a power plant, the zoning here hugs the footprint of each facility, with a safety margin of a few hundred metres, specific to each site.

But the threat behind this protection has nothing to do with the industrial espionage or sabotage feared around a nuclear site. A 2024 RAND Corporation report by Russo, Woods, Vermeer and Jackson maps out the drone threat to correctional security in the United States: mass introduction of phones and drugs, but also, in documented cases, delivery of weapons or tools meant to facilitate an escape (see the report on Google Scholar). In France, the Ministry of Justice confirmed on 14 May 2026 the acceleration of anti-drone equipment rollout across facilities, a plan worth over one million euros launched at the end of 2025: trade press now reports several thousand overflights recorded per year, against only a few dozen at the start of the decade.

Two separate offences, often stacked: flying over, then dropping the delivery

A remote pilot who flies a drone over a correctional facility commits a first offence, set out in Article L6232-12 of the Transport Code: up to 6 months' imprisonment and a €15,000 fine for negligence or carelessness, rising to 1 year and €45,000 for deliberately entering or remaining in the zone — the same penalties incurred for overflying a nuclear plant or a military site.

But as soon as the drone drops an item meant for an inmate — a phone, drugs, a weapon, even a simple USB key —, a second, independent offence applies: Article 434-35 of the Penal Code punishes delivering money, correspondence, objects or substances to a detained person outside the cases authorised by regulation, whatever the means used. The base penalty is one year's imprisonment and a €15,000 fine; it rises to 3 years and €45,000 when the offender is responsible for supervising inmates or has access to the facility through their duties — an aggravating circumstance originally designed for inside complicity, but which also covers a subcontractor or service provider who takes part in a delivery. The stacking of these two offences, aerial and criminal, explains the increasingly severe sentences handed down in recent years against organised delivery networks.

The response: jamming, acoustic detection, and the limits of each method

Neutralising a drone above an exercise yard is not a trivial act: radio-frequency jamming, the only method that genuinely severs the link between pilot and aircraft, remains a tightly controlled tool, reserved for devices authorised by the prison administration itself — a neighbouring resident or business has no right to install its own jammer, however many overflights it has witnessed. More than half of French correctional facilities are now equipped with a detection or neutralisation device, a share the Ministry of Justice has confirmed it intends to extend to the entire prison estate in the coming years.

Jamming alone does not detect much: it neutralises an aircraft already identified, but says nothing about its exact position or the precise moment of a delivery. That is the gap acoustic detection is closing, an active area of research: a 2026 study by Marcoux and Grondin describes the first acoustic detection algorithm for a drone package delivery, built on a ground-based microphone array and explicitly motivated by restricted areas such as prisons; it detects a drone's presence with 97% accuracy and correctly identifies the drop event in 96% of cases, up to 100 metres away (see the study on Google Scholar). Enough to document an incident precisely, even if neutralisation itself remains a separate exercise.

What this means for a professional mission nearby

Unlike a nuclear power plant or a military site, there is no clearance route open to a market drone provider for a prison: no photography job, roof inspection or neighbouring construction-site survey can improvise an exemption there. The rare aerial work carried out directly on a facility — roof-frame inspection, roof thermography, post-incident survey — goes exclusively through the prison administration's own procurement and cleared contractors, outside the standard quote process.

For the vast majority of professionals — a farmer, a developer, a business whose site or project sits near a facility —, the concern is the same as for any sensitive site: check the zone on Géoportail before requesting a quote, and keep a generous safety margin if the flight path skirts the boundary. A serious provider carries up-to-date professional liability insurance and a valid AlphaTango registration, two prerequisites that in no way remove the need for that check. Request a quote stating the site's exact location for any mission whose flight path might approach a correctional facility.

Does this apply to a hobbyist drone under 250 g? Yes: no-fly zones make no distinction by weight or by leisure versus professional use.

What does a company that commissioned the mission risk, beyond the remote pilot? As with other no-fly zones, the operator who commissioned the mission is also exposed — worth checking before choosing a provider for a sensitive site.
