Protected species on facades: surveying nests by drone before renovation or demolition, price

A facade renovation, an external insulation retrofit, a roof overhaul or a demolition can destroy, in a single morning of cherry-picker work, nests and roosts protected by the French Environmental Code — exposing the client to a works stoppage, criminal proceedings and a fine reaching €750,000 for a company or public body. The issue is rarely bad faith: a house martin nest tucked under an eighth-floor eaves overhang, or a three-centimetre crack through which bats reach a roof space, simply cannot be seen from the pavement. A drone makes it possible to photograph the entire building envelope before the works tender, to plot nests and potential access points on a facade drawing, and to give the ecologist a solid basis for setting the works calendar or, where needed, building a derogation file. This guide sets out what the regulations in force in September 2026 require, what a drone genuinely contributes, what it does not replace, and the prices observed.

What the client actually risks

Article L. 411-1 of the French Environmental Code prohibits, for protected species, not only killing and intentionally disturbing specimens, but also destroying, altering or degrading their breeding sites and resting places. Two ministerial orders list the species concerned: the order of 29 October 2009 setting out the list of birds protected across the whole territory and the arrangements for their protection, and the order of 23 April 2007 setting out the list of protected terrestrial mammals. House martins, barn swallows and common swifts fall under the first; every bat species in mainland France falls under the second.

The point most clients miss lies in one sentence of article 3 of the 2009 order: protection applies to breeding sites "as long as they are actually used or usable over successive breeding or resting cycles". House martins return each year to the same mud nest, which they repair, and common swifts are described as highly faithful to their cavity, reusing it every year. An empty nest in January therefore remains protected: removing it outside the breeding season is no more lawful than doing so in June.

The penalty is set by article L. 415-3 of the same code: three years' imprisonment and a €150,000 fine, doubled within the core area of a national park or a nature reserve. For a renovation contractor, a social landlord or a local authority, article 131-38 of the Criminal Code raises the maximum fivefold, to €750,000. On top of that comes the operational risk, often the more expensive in practice: a works stoppage following a report by a French Biodiversity Office officer, scaffolding tied up, delivery pushed back, and local press coverage no social landlord wants.

Finally, the Conseil d'État's litigation opinion of 9 December 2022 (case no. 463563) tightened the reading of when the obligation is triggered: a derogation must be sought as soon as the risk the project creates for protected species is "sufficiently characterised", with proposed avoidance and mitigation measures only counted where they offer genuine guarantees of effectiveness. In other words, a statement of good intent in a technical submission is no longer enough: you have to know what is actually present on the building.

Which species, where they live, and how to spot them on a facade

Four groups turn up constantly on urban renovation sites, and each leaves different traces:

In its technical guide Rénovation du bâti et biodiversité (second edition 2025, produced with the national housing agency Anah, ADEME, the French Biodiversity Office, the building science centre CSTB and the French Building Federation), the LPO identifies the main cause of these species' decline as habitat loss caused by energy renovation works, and in particular external wall insulation, which seals cavities and crevices and brings down nests fixed to the facade. One point is rarely anticipated: on an external insulation project, the thermal study and the wildlife survey cover exactly the same surface, yet one concludes that envelope defects must be sealed while the other concludes that some must be preserved. The two need to run together, not one after the other.

What the drone contributes — and what it does not replace

The drone's first contribution is geometric: in half a day, without a cherry picker, scaffolding or a road closure order, it delivers complete, dated photographic coverage of the envelope — street and courtyard facades, returns, stairwells, chimney stacks, verges, cornice and balcony soffits — at a resolution that routinely goes below one centimetre per pixel at a two-metre standoff. On that basis an ecologist can work from the office: marking every visible mud nest, every candidate cavity, every open joint, and plotting them onto a facade drawing or a rectified orthophoto. The limits must be stated plainly, because they determine the legal weight of the work. A photograph does not prove occupancy. A cavity may be empty, an old nest may be abandoned, and above all a swift nest, being invisible, can only be detected from the bird's behaviour. A study by Nicolas Sandoz and Emmanuel de Margerie published in 2026 in Ecological Solutions and Evidence illustrates the gap well: by continuously filming the facades of university buildings in Rennes for one to two hours and then fusing the video frames to reveal birds flying in and out, the authors identified 78 common swift nests and breeding populations far larger than expected, which led to 212 nest boxes being built into the renovated facades (DOI 10.1002/2688-8319.70183). The drone photographs the structure; it is behavioural observation, in season and at the right hours, that establishes occupancy.

For bats, one further precaution applies. The study by Gabrielle Ednie, David M. Bird and Kyle H. Elliott published in 2021 in Scientific Reports measured a 78% drop in detected bat passes during small commercial drone flights compared with control periods, the authors concluding that this reflected behavioural avoidance rather than mere acoustic masking (DOI 10.1038/s41598-021-90905-0). The practical conclusion: use the drone to map potential access points by day, never to run a dusk emergence count, which remains a matter for ultrasound recording and direct observation by a bat specialist.

The division of roles that works is therefore straightforward: the drone produces the exhaustive, geolocated data, the ecologist produces the interpretation and the regulatory conclusion. Setting the works calendar around the biological cycle

In the vast majority of cases, the cheapest and safest solution is neither a derogation nor compensation: it is avoidance through scheduling. But you have to know which calendar applies, since it varies with the species present — hence the value of carrying out the survey before the operation's programme is locked, rather than after the works orders have been signed.

Combining these constraints explains something every client who starts late discovers: on a building hosting both breeding birds and bats, the genuinely available window often narrows to a few weeks in autumn, between the last fledglings leaving and the onset of hibernation. The logic is exactly that of another pre-works survey already embedded in construction practice: the drone asbestos survey on roofs before works. Nobody would start a roof overhaul without it; a wildlife survey follows the same mechanics — a regulatory constraint known in advance costs a scheduling shift, the same constraint discovered mid-works costs a stoppage.

When avoidance is impossible: the protected species derogation

Some operations cannot avoid destruction: external wall insulation seals every facade cavity by design, and demolition removes the building altogether. In that case the derogation regime of article L. 411-2 (4°) of the Environmental Code applies, detailed by articles R. 411-6 to R. 411-14. A derogation is granted only where three cumulative conditions are met: no satisfactory alternative solution exists, the populations of the species concerned are maintained in a favourable conservation status within their natural range, and the project falls under one of the grounds exhaustively listed in the text — most often, for a construction project, an imperative reason of overriding public interest.

The file is lodged with State services: examined by the regional environment directorate DREAL (DRIEAT in the Paris region, DEAL overseas), with an opinion from the regional scientific council for natural heritage (CSRPN) or, depending on the species involved, the national council for nature protection (CNPN), these bodies having two months to issue their opinion, followed by signature through a prefectoral order. The reference forms are CERFA no. 13,614*01 for destroying, altering or degrading breeding sites or resting places, and CERFA no. 13,616*01 for capturing, removing, destroying or intentionally disturbing specimens; several regions having moved the procedure online, it is prudent to check the arrangements and timescales with the relevant DREAL before assembling the file. In practice, allow several months between lodging and the order: it is that duration, more than the contents of the file, that makes an early survey essential.

A derogation comes with measures prescribed under the avoid — reduce — compensate sequence. For building-dwelling species, compensation most often takes the form of nest boxes: models built into the insulation for swifts, artificial nests under overhangs for house martins, flat roost boxes or bat access tiles for bats. Their effectiveness is not theoretical: a study by Tonio Schaub, Peter J. Meffert and Gerald Kerth published in 2016 in Bird Conservation International monitored 477 nest boxes installed on 23 renovated buildings in Greifswald and measured an overall occupancy rate of 24.3%, the strongest predictor of occupancy being the number of neighbouring boxes (Cambridge Core). The directly operational lesson for a client: cluster the boxes on a single bay rather than scattering them one by one across a whole building.

Finally, the LPO guide recommends annual monitoring of the installed devices for at least five years, with corrective measures if they fail. Writing the survey into the contract: tender, specification, environmental criterion

The French Building Federation reports that some tenders now include a pre-works detection and inventory phase for bird species potentially present, together with the compensatory measures required. The LPO guide aimed at public procurement officers points the same way: run the ecological survey at programming stage, write the measures into the technical specification and the tender documents, and select contractors partly on their experience in this area — installing nest boxes, for instance.

This trend meets a shift in public procurement law. Article 35 of the Climate and Resilience Act of 22 August 2021 amended article L. 2152-7 of the French Public Procurement Code to require every public buyer to retain at least one award criterion taking the environmental characteristics of the offer into account, with the deadline set for August 2026 (the legal affairs directorate's explanatory note gives 21 August; some sources give the anniversary date of 22 August — worth confirming with the buyer for an ongoing consultation). For a local authority or social landlord launching a facade or energy renovation contract, accounting for building-dwelling species offers a concrete, verifiable environmental criterion directly linked to the subject matter of the contract, rather than a statement of intent.

In practice, a drone survey is commissioned in one of two ways. Either as a standalone client-side service, upstream, whose deliverable — a photographic report plotted on facade drawings — then feeds the technical specification and serves as an exhibit in the derogation file. Or as a lot or line item within the works contract, which is administratively simpler but carries a serious drawback: the result arrives after award, hence too late to reschedule. Across a portfolio of several dozen addresses, the first approach also allows flights to be pooled and buildings to be ranked by stake: across a portfolio, not every block carries the same risk, and a brick building with projecting cornices does not have the same profile as a 1970s slab with a smooth facade. Prices observed in 2026

The price of a drone wildlife survey depends on the height and number of facades to cover, on the level of detail required (a resolution fine enough to tell a three-centimetre open joint from a shadow means flying close, hence slowly and for longer), and on the deliverable format: a simple annotated photographic set, or observations plotted onto a rectified facade drawing. These figures cover the drone acquisition and its deliverable only. Ecological expertise is billed separately, by a consultancy or a naturalist association: it is the ecologist who concludes on the presence or absence of protected species, defines the behavioural observation protocol, sizes the measures and drafts the derogation file. Any drone contractor's quotation claiming to deliver a regulatory conclusion directly should be set aside: that is not their role, and the document would carry no weight with the DREAL.

The comparison that matters is not "drone versus cherry picker" but "early survey versus halted site". A survey flight costing a few hundred euros, flown twelve months before the works order, compares against scaffolding standing idle, a delivery pushed back, a derogation examined under emergency pressure, and a fine whose maximum reaches €750,000 for a company or public body.
